Bloodhound Gang's Russia Concert Cut Short After Officials Boot Band For Defiling Country's Flag Onstage

MOSCOW ? The American rock group Bloodhound Gang was kicked out of a Russian music festival and pelted with eggs after videos emerged of its bass player shoving a Russian flag down his pants at a recent concert in Ukraine. Russian prosecutors are even considering whether to open a criminal case in the matter, which comes amid a rise in U.S.-Russian tensions.

Videos posted online of Wednesday's concert in the Ukrainian city of Odessa show bass player Jared Hasselhoff pushing the Russian white, blue and red flag down the front of his pants and pulling it out the back. He then shouted to the audience: "Don't tell Putin," a reference to Russian President Vladimir Putin.

The incident outraged the Russian government. Maria Minina, a spokeswoman for the weeklong Kubana festival in southern Russia, said Saturday that the band's headlining performance the previous evening had been canceled because of its treatment of the flag.

The American band is known for its sexually explicit songs, including "The Bad Touch," with its unforgettable lyrics: "You and me, baby, ain't nothin' but mammals, so let's do it like they do on the Discovery Channel."

Russian Culture Minister Vladimir Medinsky tweeted Friday night that he had spoken with officials in the southern Krasnodar region, known as Kuban. "Bloodhound Gang is packing its bags," he said in the Twitter post. "These idiots will not perform in Kuban."

Hasselhoff was questioned Saturday by police, according to the Russian Interior Ministry, which said prosecutors have been asked to decide if the musician could be charged with defaming the Russian flag.

The bass player apologized late Friday at a news conference held at the music festival in the city of Anapa, the local Yuga.ru news portal reported. He was quoted saying that he had meant no offense and explaining that it was a band tradition for everything thrown from the stage first to be passed through his pants. Hasselhoff said he decided to throw the flag because some fans had seemed disturbed to see it hanging on the stage.

The scandal caused by the American band in Russia comes at a time of heightened tensions between the two countries over National Security Agency leaker Edward Snowden, who was given temporary asylum in Russia last week to help him evade prosecution in the U.S.

As the Bloodhound Gang members were driving to the Anapa airport on Saturday, activists from a pro-Kremlin youth group threw eggs and tomatoes at their vehicle, Yuga.ru reported.

The band members were taken off their afternoon flight to Moscow after they had already boarded the plane, Russian news agencies reported, citing airline officials. After being questioned by transport police, they took a later flight, the reports said.

TV film 'Sharknado' inches to cult status with midnight showings

LOS ANGELES (Reuters) - Three weeks after its premiere, "Sharknado" is still raining down great whites and hammerheads for the U.S. cable television network Syfy - and even splashing them across movie screens.

The campy, low-budget TV disaster movie about a hurricane that unleashes an aerial shark attack on Los Angeles has proven that a B-movie can still be a big cult winner, especially when social media acts as its marketing machine.

"You can't replicate something like this, you can't force-feed it - it just sort of happens," director Anthony C. Ferrante said ahead of special midnight "Sharknado" showings in 200 U.S. theaters on Friday.

Syfy already has ordered a "Sharknado" sequel and although the film is not yet a month old, it is drawing comparisons to "The Rocky Horror Picture Show," the 1975 cult classic that has made its mark as a midnight feature.

"Sharknado's" debut on July 11 drew an audience of about 1.4 million - slightly under Syfy's average for made-for-TV films - but it generated a significant 5,000 tweets per minute at its peak.

Top-shelf tweeters included "Rosemary's Baby" actress Mia Farrow, "The King of Queens" actor Patton Oswalt and "30 Rock" actor Judah Friedlander, who each enjoy large Twitter followings.

"The irony is that I thought we'd probably get the horror fans but the best we could hope for is the midnight cult following just because it was so strange and then it blew up," Ferrante said.

The film, which stars former B-list actors Ian Ziering and Tara Reid, has its lead characters attempt to save Los Angeles from "sharknados" with chainsaws and bombs as the killer fish eat their friends and destroy landmarks such as the Hollywood sign.

"Sharknado" also has attracted larger audiences in subsequent re-broadcasts, including 1.9 million on July 18 and 2.1 million on July 27.

'THIS GENERATION'S ROCKY HORROR'

"What is unusual is to have the second airing (with) more (viewers) than the first," said Horizon Media analyst Brad Adgate. "That never happens to that extent - 2.1 million isn't something that an original movie can do on Syfy."

Syfy, a unit of NBC Universal's Comcast Corp, produces about 20 films annually, including titles such as "Dinocroc vs. Supergator" and "Piranhaconda," at about $1.5 million per film.

Although "Sharknado" might not add much to Syfy's bottom line aside from some DVD sales and on-demand Internet streaming, it has been a publicity coup for the network, Adgate said.

"It put them in the mindset of viewers for what kind of movies they put on, this tongue-in-cheek, hokey type of movies," he said.

"It started in social media but it was also in the mainstream media. That's what really propelled it to become a cult classic. Maybe it's this generation's 'Rocky Horror Picture Show.'"

"Sharknado" was tailor-made bait for Twitter and Facebook with its zany premise and so-bad-it's-good special effects, social media analyst Carri Bugbee said.

"People naturally want to talk about and riff on things that are internet memes and cultural touch points, like movies, music, and TV," Bugbee said.

"If you create something wacky and outrageous it gives anybody an opportunity to say something funny to entertain their friends," she said. "I sort of see it as a natural extension of something we saw in the past with 'Rocky Horror Picture Show.'"

That low-budget cult film has grossed more than $100 million at U.S. theaters over nearly four decades.

The Facebook News Feed is a source of frustration and confusion for many. Why does it show the things it shows? Why doesn't it show every photo posted by that one girl you like? How do you control it? The social network will finally break things down on Aug. 6.

According to the press invitation for 10 a.m. PT / 1 p.m. ET on Tuesday at Facebook's headquarters in Menlo Park, Calif., Facebook will be "taking a deeper look at the ranking algorithms that determine which stories appear at the top of your feed" and discussing "a specific update to organic ranking that?s coming up."

We also expect to hear plenty of reminders about the signals we can give Facebook to help it better rank content in the News Feed. For example, liking an item, commenting, sharing, or otherwise interacting with a post can indicate that we want to see more items like that. On the flipside, hiding the post from our News Feed using the dropdown menu, signals that we don't want to see similar items as much.

How Facebook intends to improve or change the News Feed ranking remains a mystery though ? until Aug. 6, at least.

Study Claims Android Tablets Outshipped Apple?s iPad in Q2 2013

As the tablet market continues to grow rapidly, Apple?s position in the market appears to be slipping as shipments of tablets powered by Google?s Android operating system overtook the iPad in the second quarter of this year. According to market analysis firm Canalys, Apple still leads in overall tablet sales, moving 14.6 million units last quarter. The total amounts to 42.7% of the 34.2 million tablets shipped overall in the quarter, down significantly from the 71.2% share Apple held the same quarter last year.

Meanwhile, Apple?s chief rival Samsung shipped 7.37 million tablets or 21.6% of worldwide shipments, several times more than it did for the same quarter last year. Amazon, which happens to run a modified version of Android on its Kindle Fire devices, came in third place with 4.5% of shipments, followed by Lenovo and Acer at 4.3 apiece.

The four largest Android and Android-derived vendors end up account for just over one-third of the total tablet market. The remainder of the market is taken up by the 7.7 million tablets shipped by ?Other? manufacturers or 22.6% of the market. While Apple lost share, the other manufacturers listed all saw their shares grow year-over-year. Canalys? study attributes this to the tablet market coming into its own. According to Canalys analyst James Wang:

Tablets are now mainstream products and hardware innovation is increasingly difficult. With branded Android tablets available for less than $150, the PC market has never been so good for consumers, who are voting with their wallets. Apple executives have expressed the importance of the tablet in the company?s plans going forward. The company?s CEO, Tim Cook, mentioned earlier this year that the tablet represented ?the mother of all markets? and that Apple would pursue it aggressively. Cook has also cast doubt on whether buyers of non-Apple tablets are getting as much use out of their devices. With the latest figures showing the iPad holding 84% usage share according to several measures, it would appear that owners of other tablets are not using them as often as iPad owners are.

Still, Apple?s share of shipments slips overall. Canalys? report predicts that the Cupertino California company will retain a considerable lead in profitability. Apple will ?remain the tablet market?s most profitable vendor for years to come,? based on the report?s findings. The increased competition could force Apple to introduce a lower-cost iPad in the near future in order to compete against rivals. Such a device has already been predicted by many observers, who say a low-cost iPad mini could debut sometime next year. We?ll have to wait and see how Apple reacts to the trends.

CLEVELAND (AP) ? Three months after an Ohio woman kicked out part of a door to end nearly a decade of captivity, a onetime school bus driver faces sentencing for kidnapping three women and subjecting them to years of sexual and physical abuse.

Prosecutors are expected to detail Ariel Castro's daily assaults on the women, recounted in diaries that compared the women's experience to that of prisoners of war. With the possibility of the death penalty for a forced miscarriage taken off the table, Castro stands to get life in prison plus 1,000 years on Thursday.

Cuyahoga County prosecutor Tim McGinty said in a sentencing memorandum filed Wednesday that Castro, who chained his captives and fed them only one meal a day, "admits his disgusting and inhuman conduct" but "remains remorseless for his actions."

The memorandum says many of the specific charges in Castro's indictment reflect conduct documented by one of the women in her diary.

"The entries speak of forced sexual conduct, of being locked in a dark room, of anticipating the next session of abuse, of the dreams of someday escaping and being reunited with family, of being chained to a wall, of being held like a prisoner of war ... of being treated like an animal," it says.

The sentencing could take up to four hours, court officials said, with Castro, his attorneys, his victims and prosecutors getting a chance to speak. The legal team representing the women's interests declined to comment in advance on whether they would testify or send statements to the court.

In the court filing, McGinty offered new details of Castro's treatment of the women, who he said were kept "in a state of powerlessness" through physical, sexual and psychological violence.

"He made them believe that their physical survival depended on him, and he threatened to end their lives if they did not comply with his every demand," McGinty said.

Castro lured one of the women into his Cleveland home with the promise of a puppy for her son and tricked another by saying she could see his daughter, said McGinty.

He chained his captives by their ankles, fed them only one meal a day and provided plastic toilets in their bedrooms which were infrequently emptied, the filing said.

He menaced them with a gun, threatened them with tales of other captives, some of whom hadn't made it home, and at one point locked all of them in a vehicle in his garage for three days while he had a visitor.

Castro claimed he didn't have an exit strategy from his complicated double life and finally gave the women a chance to escape by leaving a door unlocked, the court filing said.

The women, each kidnapped separately when they accepted a ride from Castro on Cleveland's blue-collar west side, quickly escaped after Amanda Berry kicked out the door panel May 6 and Castro was arrested within hours. The women disappeared separately between 2002 and 2004, when they were 14, 16 and 20 years old.

There was no comment from Castro's defense team on the eve of sentencing.

Other horrific details of the women's ordeal had already emerged, including tales of being chained to poles in the basement or a bedroom heater or inside a van, with one woman forced to wear a motorcycle helmet while chained in the basement and, after she tried to escape, having a vacuum cord wrapped around her neck.

Castro repeatedly starved and beat one of the victims each time she was pregnant, forcing her to miscarry five times.

He forced the same woman on threat of death to safely deliver the child he fathered with another victim on Christmas Day 2006. The same day, prosecutors say, Castro raped the woman who helped deliver his daughter.

Prosecutors will ask the judge to prohibit Castro from ever seeing his daughter, now 6.

McGinty says experts will also discuss how Castro was able to keep the women captive for so long.

Berry, 27, made a surprise onstage appearance at a rap concert last weekend, and a second victim, Gina DeJesus, 23, made a few televised comments as a privacy fence was being erected around her house. The third victim, Michelle Knight, 32, appeared with Berry and DeJesus in a video in early July thanking the community for its support.

Eli McCullough chooses C in Philipp Meyer's highly acclaimed, brutal frontier novel, The Son. Meyer's first novel ?American Rust,? chronicled the slow death of a small Pennsylvania steel town and the evaporating of hopes of its two protagonists. ?The Son,? which seems certain to cement Meyer's reputation, takes on a bigger geography, but decline is still the theme. In the process, he's written a Texas epic that can stand alongside classics by Larry McMurtry and Cormac McCarthy.

Kidnapped after a vicious attack on his family, Eli, or Tiehteti as the Comanche rename him, is the consummate survivor. (The 12-year-old doesn't waste much time grieving ? his bookish brother was an embarrassment, and his sister never liked him much.) Looking back at his long life from 1936, the centenarian tells a WPA interviewer about outliving both his biological and adoptive families and the frontier he adored.

?The Son? also follows two of Eli's descendants, Peter, who in 1915 is unable to stop the slaughter of his Mexican neighbors; and Jeanne, who at age 86 is lying on the floor of her home, unable to move and unable to remember how she got there. (Alarmingly, she can smell gas, and there seems to be a haze of smoke filling the room.) In the beginning, readers may resent any switch away from Eli, but Meyer jumps masterfully between eras, able to recreate a Comanche raid with as much detail as a boarding school sleepover, and the attendant perils of both.

When Eli was a child, ?the country was rich with life the way it is rotten with people today,? he tells WPA worker recording him on tape.

While he longs for the days when the grass was chest-deep, Eli acknowledges he's done his fair share to exploit the area's natural resources ? grabbing all the land he can, by fair means or foul, and first covering it with cattle and then oil rigs, a task his great-granddaughter carries on to advance the family fortunes.

?I don't have to tell you what this land used to look like. And you don't have to tell me that I am the one who ruined it,? Eli tells his Peter. ?But that is the story of the human race. Soil to sand, fertile to barren, fruit to thorns. It is all we know how to do.?

Eli's adopted father tries to teach him the importance of putting the tribes' lives ahead of his own, but he absorbs another lesson better: the only way to own a hunk of Texas is to take it from someone else. The waves of invasions, of course, had been going on since before his birth, as Toshaway points out. The Comanche had taken the area from the Tonkawa and then the Mexican and American settlers took it from them.

?The whites do not think this way ? they prefer to forget that everything they want already belongs to someone else,? Toshaway tells Eli. ?They all want to be rich, same as we do, but they do not admit to themselves that you only get rich by taking things from other people. They think that if you do not see the people you are stealing from, or if they do not look like you, it is not really stealing.?

Eli becomes an equal opportunity killer, as first a Comanche warrior, then a Texas ranger.

In 1915, Peter, a far more morally complicated man than his father, grapples with the fallout from that way of thinking, falling into self-loathing and depression. (There is, it should be noted, far more whining in Peter's chapters. He is, however, the McCullough least likely to gut you ? either literally or metaphorically.)

Appalled by the treatment of the Garcias, and the casual annexing of their land, Peter can't live with the colonel's justifications anymore.

?That is how the Garcias got the land, by cleaning off the Indians,? Eli tells him. ?and that is how we had to get it. And one day that is how someone will get it from us. Which I urge you to remember.?

Jeanne, on the other hand, adores her great-grandfather, the Colonel, and thoroughly absorbs his lessons in a way her cowboy-playing father never did:??The strong took from the weak, only the weak believed otherwise,? she thinks, alone in the family mansion.

She bucks society's expectations to become an oil baron, but it's as lonely an existence as her grandmother, who hoped to turn her into a pearl-wearing debutante, warned.?

?Men, with whom she had everything in common, did not want her around. Women, with whom she had nothing in common, smiled too much, laughed too loud, and mostly reminded her of small dogs, their lives lost in interior decorating and other people's outfits. There had never been a place for a person like her.?

While Eli remains the most compelling character in "The Son," Meyer skilfully weaves together all his time-traveling threads, as the events of one era pay bloody dividends in the next.

The Eagle Ford Pure Play

Energy companies are making a huge bet on South Texas. The Eagle Ford is now the largest single oil and gas development in the world based on capital expenditures. The Eagle Ford Shale is a geological formation spreading across some 20 counties from southern to central Texas. It is believed to be the "source rock" for all the hydrocarbons above it, including dry gas, wet gas, natural gas liquids, condensate and finally oil.

The Eagle Ford has attracted companies big and small. It was originally discovered by PetroHawk in 2010. Big capital early movers include ConocoPhillips (COP), EOG (EOG), Chesapeake (CHK) and Anadarkro (APC). PetroHawk would later be bought by mega cap resource company BHP Billiton.

All of these above companies have their eggs in many different baskets. To get a pure play on the Eagle Ford we have to look for much smaller operators. Today I'm going to look at one of those companies, Sanchez Energy (SN).

A Unique Concentration

Sanchez Energy is an independent exploration and production company whose concentration is entirely in the Eagle Ford Shale. Its market cap sits at $845 million. While operations are entirely in the Eagle Ford, Sanchez does have some undeveloped land in the Woodbine of East Texas and the Montana portion of the Bakken.

Texan readers may remember the 2002 Democratic Gubenatorial candidate Antonio "Tony" Sanchez and his bid to unseat Rick Perry. Well, he's now the CEO and founder of this company which bears his namesake.

Amazing Returns In The Core "Sweet Spot"

Management's goal is pretty straightforward: To build a portfolio of contiguous producing acreage that can benefit from economies of scale. Sanchez was fortunate enough to be an early, nimble mover and wisely concentrated on oily assets. As of today, 75% of its reserves are oil.

While Sanchez has four contiguous producing areas here, the most prolific by far is "Palmetto" in Gonzales County, the core of this shale play. Palmetto accounts for 62% of Sanchez's production. This is some of the best land in the Eagle Ford, surrounded by big players like Conoco and EOG. At $90 oil, it fetches an amazing 119% Internal Rate Of Return.

Growth Hits An Inflection Point

Production in Q1 grew by 320% over last year and revenue grew by 303%. Management's target for 2013 is triple-digit production growth once again.

Yes, this growth is very impressive given some of the well economics, but this year Sanchez hit its growth inflection point. Going forward, Sanchez will be more about development and less about acquisitions and explosive growth. There will likely be continued growth in 2015 and beyond, but it will not match the acquisition and exploration-fueled growth of last year's.

Profitability

As with most oil companies at this stage of its life, Sanchez has yet to post a profit. Don't expect this trend to reverse too soon, either. The development stage will also require a lot of capital. But there is light at the end of this tunnel.

First, Sanchez is steadily lowering well costs. The cost per well is at a very high $10 million but new wells this year should cost only $9.5 million on average. While these wells are more expensive than Conoco's or even a peer such as Carrizo (CRZO), the costs are coming down. This is being driven by multiple well pads and a shared infrastructure.

Second is Sanchez's funding gap. A funding gap is when an energy company's Capital Expenditure (for growth) exceeds Operating Cash Flow. While the funding gap seems large and growing out of control, remember that the company was in acquisition mode until only recently. Now that Sanchez has hit its inflection point, we can expect the funding gap to start closing. All other things being constant, management expects Sanchez to be capital neutral by 2015 on profitable development and efficiency efforts.

But the key phrase is "all other things being constant." There's a good chance Sanchez will find some other Eagle Ford opportunities in these next couple years.

Debt

Amazingly, Sanchez has grown with little or no debt up until very recently. We shouldn't expect this trend to continue much longer for a couple of reasons, however. As Sanchez moves into its development stage and out of exploration, it will become more efficient and less risky, improving its standing in the eyes of creditors. This will reduce its cost of borrowing and make debt a more attractive option.

Secondly, they themselves have said as much.

In connection with the acquisition we have secured commitments for $325 million in debt financing

and expect to access the capital markets in the near term, subject to market conditions and other factors.

This financing likely has to do with a recent acreage acquisition from Hess just a ways up the road from Laredo, which I will cover in a moment. But regarding debt, Sanchez will be looking more conventional soon. Perhaps, the most important takeaway here is that Sanchez has the capacity to develop and acquire in the Eagle Ford.

Acquisition

In May of this year Sanchez completed an acquisition of 43,000 net acres outside of Coatulla, between Laredo and San Antonio, from Hess. This acquisition has added 13.4 million Barrels Of Oil Equivalent to Sanchez's reserves, 70% of which is oil.

Hess sold from a position of weakness, having to streamline operations under shareholder pressure. Paying $265 million to add 4,500 barrels of production per day, Sanchez paid a fair price. At $90 oil, we are looking at a breakeven period of 900 days from just the acquisition price.

Skepticism is not unwarranted here, but if you believe the Eagle Ford to be a decades-long play, then this acquisition will be a good one. Hess lacked the means to focus in South Texas and probably wanted to concentrate more on the Bakken. Sanchez will be able to develop the Coatulla assets just fine.

Valuation

Sanchez is difficult to value for two reasons. First, there aren't yet any profits, so P/E ratios are not useful here. Instead we will look at Price / Book ratios. Another difficulty is that Sanchez has so few peers. Comparing it to larger companies in the Eagle Ford would not really be appropriate. We need smaller, Eagle Ford centered companies. The closest two are Rosetta Resources (ROSE) and Carrizo: Both of them are primarily in the Eagle Ford, although Carrizo has assets in several places. And compared to these names, Sanchez is cheap.

At 1.3 times book value, Sanchez looks quite a bit cheaper than Rosetta and Carrizo. It's not quite clear why it may be at such a discount. Sanchez is much more conservatively leveraged than either of these. Sanchez's Palmetto assets outperform anything either one has. Maybe the market doesn't like Sanchez's well cost, which is considerably higher than either one. Or maybe the market is just overlooking Sanchez.

So what's the downside? At just one times book, the stock would be down by about 23% from here. If the Eagle Ford develops as many think it will, however, Sanchez could become a multi-billion dollar company. The current market cap is $867 million.

Conclusion

Sanchez is only an $867 million company, but I believe it can be a multi-billion dollar one as the Eagle Ford develops over time. Its sole focus on this formation provides something unique and simple for investors to participate in. It's pretty simple: If you like the Eagle Ford, you'll like Sanchez Energy.

Fire reveals dozens of marijuana plants growing in Florida home

ST. PETERSBURG, Fla., July 31 (UPI) -- Authorities in Florida say firefighters responding to an electrical fire discovered 75 to 100 marijuana plants being grown in a locked bedroom.

The St. Petersburg Police Department said in a Facebook post firefighters responded to a St. Petersburg address at 6:28 p.m. Monday and resident Gaetano Rodriguez, 27, refused to unlock the door to a bedroom where flames were located.

Rodriguez, who rents the house from his father, was forcibly removed from the house and firefighters broke into the room, where they discovered dozens of marijuana plants.

Rodriguez initially claimed the marijuana for medicinal use, but later told officers he had been planning to sell it.

He was taken to the Pinellas County Jail on charges of obstructing firefighters and cultivation of marijuana.

Student Loans: College Costs Will Continue to Rise

Last week, the Senate passed a bill that would peg interest rates on federal student loans to Washington?s cost of borrowing (the Treasury rate) plus 2.05 percent. The bill also caps interest rates at 8.25 percent in the event they rise in the coming years. The House has praised the move, meaning it is likely to become the law.

While this may make students happy, there are some serious policy limitations that should have taxpayers concerned:

    • Capping interest rates is bad policy.?Any proposal to reform federal student lending that attempts to be more market-based should be uncapped. When markets improve, and these rates rise, they hit a cap at 8.25 percent. So if the market rate would have meant interest rates of 9.5 percent, the cap prevents them from actually reflecting that market rate.
    • It eschews fair-value accounting.?The current proposal lacks any requirement for interest rates to be set according to fair-value accounting. Any federal student loan program should use a non-subsidizing interest rate?i.e., the rate at which the program breaks even?to make sure the proposed 10-year Treasury rate plus 2.05 percent interest rate isn?t creating a taxpayer-financed subsidy.

  • It does not help to reduce college costs.?The deal on student loan interest rates does not fundamentally solve the college cost problem. Once again, the policy provides access to easy money for students, enabling universities to continue to raise tuition.
  • While this may provide some relief for students, the interest rate debate is a shiny object distracting policymakers from larger higher education cost issues.?Allowing the rates to stay at the current 6.8 percent isn?t the burden on students and recent graduates the Administration and many on the left make it out to be. The new rate only affects new borrowers; no students who took out loans prior to July 1, 2013, will be affected. Even for those students who fall under the current 6.8 percent rate, the difference they will pay per month is estimated to be between $20 and $40.

President Obama should have taken the opportunity in his speech this week to champion reforms to the ossified accreditation system, given a nod to low-cost degrees that are under development in the states, and most importantly, talked about winding down federal intervention in the student loan market by?limiting?access to easy money in order to put pressure on universities to lower costs.

HARRISBURG, Pa. (AP) ? The Jerry Sandusky scandal appears headed for another court battle that is sure to prolong the media spotlight and relive the testimony of how the former Penn State football icon molested boys, sometimes in the school's facilities.

Penn State's ex-president and two former top school administrators were ordered Tuesday to stand trial on charges accusing them of covering up their failure to tell police about a 2001 allegation that Sandusky molested a boy in a university locker room shower, even after they knew police investigated complaints about Sandusky showering with boys in 1998.

It was, said lead state prosecutor Bruce Beemer, a "conspiracy of silence."

District Judge William Wenner called it "a tragic day for Penn State University" after ruling that prosecutors showed enough evidence during a two-day preliminary hearing to warrant a trial for ex-President Graham Spanier, former vice president Gary Schultz and ex-athletic director Tim Curley.

The key testimony centered on a series of emails among the three defendants that discussed the 1998 and 2001 cases and the testimony of Mike McQueary, a former team assistant and quarterback who said he had immediately told Schultz, Curley and the late longtime football coach Joe Paterno that he had seen Sandusky molesting a boy in the shower in 2001.

Spanier's lawyer, Elizabeth Ainslie, told Wenner that the case against him "amounts to innuendo and far-fetched inference." Meanwhile, Curley's lawyer, Caroline Roberto, took aim at McQueary, saying his testimony included "embellishment" and that every time he testifies he says "something more or different."

Sandusky, a defensive coordinator under Paterno until his retirement in 1999, was convicted last year of 45 counts of child sexual abuse. He maintains his innocence and is appealing a 30- to 60-year state prison term.

Anthony Lubrano, a Penn State trustee who watched the two days of testimony, said he had not expected Wenner to throw out the case, given the low level of evidence necessary to send the case to trial. However, he said, "if you get an unbiased jury (at a trial), it'll be hard to get those charges to stick."

Spanier testified to a grand jury that he was unaware of the 1998 investigation while Curley and Schultz testified that McQueary reported only that Sandusky and the boy were engaged in naked, inappropriate horseplay that made him uncomfortable. Once the defendants became aware of an investigation into Sandusky in 2010 or 2011, they did nothing to stop it, obstruct it or hide evidence, their lawyers said.

The three were charged with perjury, obstruction, endangering the welfare of children, failure to properly report suspected abuse and conspiracy. Those charges include allegations of hiding evidence from investigators and lying to the grand jury.

Penn State and the Paterno family declined to comment.

Curley and Schultz were initially charged in November 2011, when Sandusky was arrested, and accused of perjury and failure to properly report the incident.

Spanier was forced out as president at that time. A year later, he was charged with covering up a complaint about Sandusky while additional charges were filed against Curley and Schultz. Spanier remains a faculty member on administrative leave.

Paterno was fired and died in January 2012.
